Privacy Policy

Your privacy is extremely important to us. We are constantly putting great deal of thought, efforts, tools and procedures in order to protect and safeguard your privacy. This document is our "Privacy Policy" and it contains details on issues related to your privacy when using our services. It is intended to inform you of our policies, procedures and practices regarding the collection, use and disclosure of any information that you provide through the Platform. The Privacy Policy is part of our Terms and Conditions which can be found in our website. The terms in the Privacy Policy (such as, but not limited to, "we", "our", us", "Platform", Provider", "Provider Services" etc) have the same meaning as in our Terms and Conditions document. When you use our Platform you accept and agree to both the Terms and Conditions and to the Privacy Policy. If you do not agree to be bound to the Privacy Policy you should stop using the Platform immediately. By accessing and using our Platform you affirm that you have read the Terms and Conditions and the Privacy Policy and that you understand, agree and acknowledge to all the terms contained in both of them.

Information Collection and Use

To let us operate the Platform effectively and to let you use the Platform, including the Provider Services, we have to collect and use some information from you (the "Information"). Some functions of the Platform may not be available to you without providing us the necessary Information. By deciding to provide the Information you agree to our methods of collections and use, as well to other terms and provisions of this Privacy Policy. The different types of Information we collect and how we intend to use them are detailed below.

  • Personally Identifiable Information:

    When you sign up to the Platform, update your account details, provide your billing information, provide your emergency contact information or make other use of our services, we may ask you for personally identifiable information ("Personal Information"). The Personal Information can be used can be used to contact you or identify you and it may include, but not limited to, your name, your email, your phone number, your address and your credit card information. We may use the Personal Information, either by itself or in conjunction with other information, for the following purposes:

    • Create your account at our Platform, let you log in to the account, administer your account, monitor your account, provide customer service and contact you with information, alerts and suggestions that are related to your account.
    • Billing-related purposes.
    • Reach out to you, either ourselves or using the appropriate authorities, if either we or a Provider has a good reason to believe that you or any other person may be in danger or may be either the cause or the victim of a criminal act.
    • Let a Provider know your first name so he or she can communicate with you effectively.
    • Let a Provider know your state to ensure he is licensed and qualified to provide a service to you.
  • Profile Information:

    We may ask you several questions about you and your needs. ("Profile Information"). This information is shared with Providers that use our Platform. We may use the Profile Information, either by itself or in conjunction with other information, for the following purposes:

    • Match you with a Therapist
    • Help us and our Therapists to get to know you and your needs.
  • Log Data:

    When you use the Platform, our servers or servers of third party services automatically record information that your browser sends ("Log Data"). This Log Data may include, but not limited to, information such as your computer, Internet Protocol address ("IP"), pages that you visit and the time spent on those pages, actions that you take and other statistics. We may use this information, either by itself or in conjunction with other information for the following purposes:

    • Monitor, analyse and improve the use and functionality of the Platform, the Platform's technical operation and the match of the Platform functionality to your needs and preferences.
  • Session Content:

    While using the Platform you and a Therapist would likely write or say things by means of text-based communication (such as messages), verbal communication or video communication, either internally or to each other (collectively "Session Content"). The Session Content is shared with the Provider(s) that work with you. The Session Content may be used, either by itself or in conjunction with other information, for the following purposes:

    • Let a Provider provide the service to you.
    • Supervise, administer and monitor the service.

    Note that all communications transmitted through the Platform, will be recorded or monitored for quality assurance and training purposes and become part of your file and records in accordance with the regulatory Code of Ethics.

    We will keep your information confidential except where disclosure is required or permitted by law (for example to government bodies and law enforcement agencies or during an emergency circumstance as judged by your Therapist working with local authorities). We will only use your information within our company. However, sometimes we use third parties to process your information (for example as credit card payment providers). We will require these third parties to comply strictly with its instructions and we will require that they not use your personal information for their own business purposes.

  • Minors

    The Platform is not directed and not intended to be used by minors unless they have parental consent. Adolescents between the age of 13-17 may begin therapy, however a parent/guardian will need to consent for the adolescent to enter therapy. Therapists may not be able to share all information with the parent/guardian without a signed release, to protect privacy and confidentiality of the adolescent unless there are issues of risk and safety involved.

The Uses of the collected Data by MyMind

MyMind uses non-identifying (De-Identified or “Safe Harbor” form) and aggregate information about responses to the clinical outcome assessments (personal assessments), and the frequency of the utilisation of the MyMind service. These efforts enhance program evaluation.

The anonymous and aggregated data also may be published through various media platforms/academic journals. No personal identifying information will be tied to the results, and MyMind will not share anything that could be used to identify your account or your private information.

From time to time, we may use customer information for new, unanticipated uses not previously disclosed in our privacy notice. If our information practices change at some time in the future we will contact you before we use your data for these new purposes to notify you of the policy change and to provide you with the ability to opt out of these new uses.

MyMind stores data only for as long as it is necessary to provide products and services to you and others, including those described above and for legal protections or as required by applicable laws and regulations.

MyMind may allow service providers to access information so they can help us provide services.

IP addresses are used to identify the location of users, the number of visits from different countries and also to block disruptive use; and to analyse and improve the services offered on our website, e.g. to provide you with the most user-friendly navigation experience.

Certain information is needed to provide you with services, so we only delete this information after you delete your account.

When you delete IP content, it is deleted in a manner similar to emptying the recycle bin on a computer. However, you understand that removed content may persist in backup copies for a reasonable period of time (but will not be available to others).

Protecting the Privacy of your fellow MyMind Users

During your use of MyMind services, you will not send or otherwise post unauthorised commercial communications (such as spam) on MyMind.

You will not collect users' content or information, or otherwise access MyMind, using automated means (such as harvesting bots, robots, spiders, or scrapers) without our permission:

You will not upload viruses or other malicious code.

You will not solicit login information or access an account belonging to someone else.

You will not bully, intimidate, or harass any other User.

You will not post content that: is hateful, threatening, or pornographic; incites violence; or contains nudity or graphic or gratuitous violence.

You will not provide any false personal information on MyMind or create an account for anyone other than yourself without permission. You will not create more than one personal profile.

Copyrights: MyMind and Protecting Other People's Intellectual Property Rights

We respect other people's rights, and expect you to do the same. You will not post content or take any action on MyMind that infringes or violates someone else's rights or otherwise violates the law. We can remove any content or information you post on MyMind if we believe that it violates this Privacy Policy or the Terms of Use on this Site. You will not use our copyrights or any confusingly similar marks, without our written permission. If you collect information from MyMind Users, you will: obtain their consent, make it clear you are the one collecting their information, and post a privacy policy explaining what information you collect and how you will use it. You will not post anyone's identification documents or sensitive financial information on MyMind.

Portable Electronic Devices

The MyMind Platform is available on a multitude of portable electronic devices. We provide our connection to mobile services for free, but please be aware that your carrier's normal rates and fees, such as text messaging fees, may still apply. You provide all rights necessary to enable MyMind Users to sync (including through an application) their contact lists with any basic information and contact information that is visible to them on MyMind, as well as your name and profile picture.

Your Use of Your Personal Data

If a MyMind User utilises the Platform to publish or otherwise share their own Personal Data or Contact Information with third parties, he or she assumes full responsibility for any further use of that Data or information.

Disputes

You will resolve any claim, cause of action or dispute (claim) you have with us arising out of or relating to this Statement or MyMind exclusively in a state or federal court located Queensland. The laws of this area will govern this Statement, as well as any claim that might arise between you and us, without regard to conflict of law provisions.

If anyone brings a claim against us related to your actions, content or information on MyMind, you will indemnify and hold us harmless from and against all damages, losses, and expenses of any kind (including reasonable legal fees and costs) related to such claim.

Cookies

A cookie is a small amount of data, which often includes a unique identifier that is sent to your computer, tablet, phablet, cell phone or other electronic devise (referred to here as a "device") browser from a website's computer and is stored on your device's hard drive. Each website can send its own cookie to your browser if your browser's preferences allow it, but (to protect your privacy) your browser only permits a website to access the cookies it has already sent to you, not the cookies sent to you by other sites. During the course or any visit to the Site, the pages you see, along with a cookie, are downloaded to your device. This is done on a repeat visit by checking for the cookie left there on the previous visit.

Information supplied by cookies can help us to analyse the profile of our visitors so we can provide you with a better user experience.

Definitions

Clinical Assessments: Questions from clinical scales that measure mental health and well-being. Clinical assessments vary by condition.

Data/results: The quantitative scores that are based on responses to questions in the assessments.

Personal identifying information: Name, address, credit card number.

MyMind is not responsible for the actions, content, information, or data of third parties, and you release us, our directors, officers, employees, and agents from any claims and damages, known and unknown, arising out of or in any way connected with any claim you have against any such third parties.

We strive to create a community with consistent standards for everyone, but we also strive to respect local laws.

MyMind openly volunteers its practices of collecting information, its targeting capabilities, and its use of cookies. If you have any questions pertaining to this privacy policy and its contents, please direct your correspondence to MyMind at the "contact us" link on the website.

Understand, that we treat your use of our platform with the utmost respect to your privacy. We keep all information not disclosed above private between the Therapist and the User, keeping only non-decimated "file" copies for reference in case of legal dispute of by court order as we are required to under Federal Laws for period up to seven years or by the applicable State Regulation. File retention protects both the User and the Therapists safety. MyMind is not responsible for data lost/exposed/used due to the nature of the Internet and digital environments, including illegal actions of hackers and criminals, technical malfunctions of servers and database etc. These are the accepted risks of our Users and users of the Internet in general. You are agreeing to this standard in using our site.

MyMind reserves the right to amend this Privacy Statement at any time without notice, and only the current Privacy Statement may be deemed effective. Regardless of later updates or changes to our privacy notice, we will never use the information you submit under our current privacy notice in a new way without first providing you an opportunity to opt-out or otherwise prevent that use.
